Terms of Use

These Terms of Use ("Terms") govern your use of SmartSadaka, including the web system used by churches and the SmartSadaka mobile app used by church members (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
SmartSadaka helps churches record and manage tithes, offerings, pledges, stewardship goals, expenses, budgets, payroll, accounting and reports, and lets members view their giving, upload payment receipts and receive announcements. SmartSadaka is a record-keeping and communication tool. Unless stated otherwise, SmartSadaka does not receive, hold or transfer church funds; money is paid directly to the church through its own bank or mobile money accounts.
2. Accounts and security
- Church accounts are created for authorised church leaders. Member accounts are linked to records created by the member's church.
- You must give accurate information and keep it up to date.
- You are responsible for keeping your password, PIN and one-time codes secret, and for all activity under your account.
- Tell your church or us immediately if you think your account has been used without permission.
3. Responsibilities of churches
- The church is responsible for the accuracy of the records it enters and for approving contributions, expenses and reports.
- The church must have a lawful basis, and consent where required, for the member data it enters, and must handle it in line with the Personal Data Protection Act, 2022.
- The church controls which staff have access and what permissions they have, and must remove access when someone leaves their role.
- The church must use messaging features (SMS, WhatsApp, email) only for legitimate church communication and not for spam.
4. Responsibilities of members
- Only upload genuine payment receipts that belong to you. Uploading false receipts may lead to your account being suspended and the matter being reported to your church.
- Contributions shown in the app are confirmed by your church. If a record looks wrong, raise it with your church treasurer.
5. Acceptable use
You must not:
- Post content that is unlawful, offensive, defamatory or harmful to others in posts or comments.
- Try to access data or accounts you are not authorised to see.
- Interfere with, attack or overload the Service, or try to reverse-engineer it.
- Use the Service for fraud, money laundering or any other illegal activity.
We and your church may remove content or suspend accounts that break these rules.
6. Fees and messaging credits
Churches may pay subscription fees agreed with SmartSadaka and may buy messaging credits (SMS and WhatsApp) in the system. Credits are deducted as messages are sent. Unless required by law or agreed in writing, payments and unused credits are not refundable. Online card payments are processed by Stripe, subject to its own terms.
7. Privacy
Our use of personal data is described in our Privacy Policy, which forms part of these Terms.
8. Intellectual property
SmartSadaka, its software, design and branding belong to SmartSadaka. Churches and members keep ownership of the data and content they put into the Service, and give us permission to process it only to provide the Service.
9. Availability and changes to the Service
We work to keep the Service available and accurate, but it is provided "as is" and may sometimes be interrupted for maintenance, upgrades or reasons outside our control, such as network or SMS provider outages. We may improve or change features over time.
10. Limitation of liability
To the extent allowed by law, SmartSadaka is not liable for indirect or consequential losses, for errors in records entered by churches or members, or for delays or failures of third-party services (banks, mobile money, SMS, WhatsApp or internet providers). Our total liability to a church for any claim is limited to the fees that church paid to SmartSadaka in the 12 months before the claim.
11. Suspension and termination
You may stop using the Service at any time. A church may close its account by contacting us, and can ask for an export of its data before closure. We may suspend or end access if these Terms are broken or fees are not paid. After closure, data is kept or deleted as described in the Privacy Policy.
12. Governing law
These Terms are governed by the laws of the United Republic of Tanzania. We will try to resolve any dispute amicably first; if that fails, the courts of Tanzania have jurisdiction.
13. Changes to these Terms
We may update these Terms. The "Last updated" date shows the latest version. Continuing to use the Service after a change means you accept the updated Terms.
